Welcome to Eatly. These Terms of Service ("Terms") govern your access to and use of the Eatly mobile application and website (collectively, the "Service"), operated by Euvoa ("we," "us," or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Description of the Service
Eatly lets you scan food and beauty products to view ingredient information, nutrition data, and product scores intended to help you make more informed choices. Product information is sourced from third-party databases, including Open Food Facts and Open Beauty Facts, and from data you submit through scans.
2. Not Medical or Professional Advice
The scores, ratings, and information provided by Eatly are for general informational purposes only. They are not medical, nutritional, dermatological, or other professional advice, and they are not a substitute for consulting a qualified professional. Always check product packaging directly — especially for allergens — and consult a doctor, dietitian, or other professional before making decisions about your health, diet, or skincare.
3. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.
4. Accounts
Some features may require you to create an account. You agree to provide accurate information, keep your credentials secure, and notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms.
5. Acceptable Use
When using the Service, you agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law;
- Attempt to gain unauthorized access to the Service, its servers, or related systems;
- Interfere with or disrupt the operation of the Service;
- Scrape, harvest, or extract data from the Service through automated means without our permission;
- Reverse engineer, decompile, or disassemble any part of the Service, except where permitted by law;
- Submit false, misleading, or malicious content or data;
- Impersonate any person or misrepresent your affiliation with any person or entity.
6. Intellectual Property
The Service, including its design, logos, text, graphics, and software, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
7. Third-Party Content and Services
Product data displayed in the Service is sourced in part from third-party databases such as Open Food Facts and Open Beauty Facts, which are maintained by independent communities. We do not control and cannot guarantee the accuracy, completeness, or timeliness of third-party data. The Service may also contain links to third-party websites or services that we do not operate; we are not responsible for their content or practices.
8. Accuracy of Information
While we strive to provide accurate and up-to-date information, product formulations, ingredients, and labeling change frequently. We make no warranty that the information, scores, or recommendations provided through the Service are accurate, complete, or current. You rely on this information at your own risk.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
11. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if we discontinue the Service. You may stop using the Service at any time by uninstalling the app. Sections that by their nature should survive termination (including Sections 6, 10, 11, and 12) will survive.
14. Changes to the Service and These Terms
We may modify, suspend, or discontinue the Service (or any part of it) at any time. We may also update these Terms from time to time. If we make material changes, we will update the effective date above and may provide additional notice through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we are established, without regard to its conflict of law provisions. Nothing in these Terms limits any mandatory consumer protection rights you may have under the laws of your country of residence.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
